2. Purpose, scope and definitions

This Privacy Notice describes how we collect and use your personal information in relation to Flybotix websites, applications & recruitment process, products, services, events, and experiences that reference this Privacy Notice, together: “Flybotix Offerings”.

 

2.1 Legal basis

The processing of your data is either based on your consent or in case the processing is necessary for the performance of a contract to which you are a party, or to take steps at your request prior to entering into a contract, or based on legitimate interest, cf. EU GDPR art. 6(1)(a)-(b), (f), cf. Swiss FADP (Federal Act on Data Protection).

If the processing is based on your consent, you may at any time withdraw your consent by contacting us using the contact information in clause

As the developer of products and services, Flybotix can access any software component remotely for maintenance, updates, customer support and monitoring purposes. Flybotix never signs into a specific account (unless formally requested to) but has only a global access to the platform as an administrator.

Platforms

Platforms in the Flybotix context means all the digital places that makes accessible a variety of information to the Flybotix products or services, such as the video inspections, data collected during and post inspections, flight logs and / or additional analytics and business intelligence analysis.

User

The User in the Flybotix context is a person who will have an account to sign in on a platform, websites or services. This account will have certain permissions and will contain personal information.

Personal Data

In the context of this Notice, the reference to “Personal Data” includes several types of data (ex: User’s Data, video data, access data, information collected from your browser or tracking techniques, job applicant’s data), not including metadata.

 

3. General Information about data collected and processed.

3.1 Who is collecting the data?

You as User are collecting data when a drone is active, using its video cameras and sensors, as well as when using our Platforms and entering data.

We as Flybotix collect the data needed for you to access the Platforms; we are also hosting your data including your video recordings on a cloud of a third-party cloud service (see your profile for further details) and are processing the data as to provide you with the needed information and services.

3.2 What data are being collected and processed?

3.2.1 Personal Data we collect and process from you the User:

Your Personal Data you enter to use or download one of our products, or subscribe to one of our services (including newsletters), or fill in one of our contact forms, or request support (by any communication channel), you voluntarily give us certain information.

No processing of Personal Data is done on User’s data. This Information is only used as static information for platform login and usage. No individual person is identified nor identifiable by a third party.

3.2.2 Job Application Data

When you apply for a job on our website or via an employment agency, we usually collect your contact information (name, email, phone, nationality, birthdate) and any information you choose to share with us in your introduction letter and Curriculum Vitae. If we decide to send you a job proposition, we will also ask you to provide extra personal details as required to fulfil our legal obligations and personnel management requirements.

We will not ask you to provide information that is not necessary for the recruitment process. In particular, we will never collect any information about your racial or ethnic origin, political opinions, religious beliefs, trade union membership or sexual life.

3.2.3 Browser Data

When you visit our website and access our online services, we detect and store your browser language and geolocation to customize your experience according to your country and preferred language. Our servers also passively record a summary of the information sent by your browser for statistical, security and legal purposes: your IP address, the time and date of your visit, your browser version and platform, and the web page that referred you to our website.

Your browser may also be used to store and retrieve your current session data, with the help of a session cookie (see also the Cookie section for more details).

Form protection: some forms on our website may be protected by Google reCAPTCHA. This technology relies on heuristics that are based on the technical characteristics of your browser and device and may also use specific Google cookies. 3.2.4 Analytics and Performance Data

Our Platforms are all generating data in the kind of usage metrics, collecting sensor’s state over time, battery charging and efficiency, Autopilot state and decisions, AI efficiency and accuracy and all sorts of data that may help us improve our Products and Services of our Platforms.

By using our Platforms, you consent to automatically share data fully anonymized for the above purpose.

3.2.5 Inspection Data

In essence, data generated during inspections should be stored on our Platforms for long term storage, year-by-year evolution comparisons, analysis and visualisation. Flybotix will never disclose any Asset and Inspection related data. We keep the right to access impersonated data (anonymised data) to improve/train/validate AI algorithm we use in adequation with inspector’s rating of Points of Interests.

 

3.3 How we Use Personal Information?

 

We use your personal information to operate, provide, and improve Flybotix Offerings. Our purposes for using personal information include:

  • Provide Flybotix Offerings: We use your personal information to provide and deliver our Services, operate the Platforms and process transactions related to Flybotix Offerings, including registrations, subscriptions, purchases and payments.
  • Personalisation: We use your personal information to identify your preferences and personalise your experience with Flybotix Offerings.
  • Measure, Support and Improve the Platforms: We measure the use of, analyse the performance of, fix errors in, provide support for, improve & develop our Flybotix Offerings.
  • Communicate with You: We use your personal information to communicate with you in relation to Flybotix Offerings via various channels (e.g., by email, chat, phone, etc..) and to respond to your requests.
  • Marketing: We use your personal information to market and promote Flybotix Offerings, including newsletter but not limited to.
  • On-purpose with your Consent: We may also ask for your specific consent to use personal information for a specific purpose that we communicate to you.

3.4 What rights do you the user have?

We aim to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data.

Whenever made possible, you can update your User’s Data directly within your account settings section. If you are unable to change your User’s Data, please contact us at privacy@flybotix.com to make the required changes.

You are entitled to exercise any time the following rights with Flybotix:

• To access and receive a copy of the Personal Data

• To rectify any Personal Data that is inaccurate

• To request the deletion of Personal Data

You have the right to data portability for the information you provide us with. You can request to obtain a copy of your Personal Data in a commonly used electronic format.

Please note that we may ask you to verify your identity before responding to such a request.

 

3.5 What obligations do you the User have?

You the User are responsible for your authentication details. As potential delegated Administrators of your Company on our Platforms, you can create or grant existing Users rights, so you are responsible for the authorisations you give to other Users, including Users of Companies different than yours using our Platforms.

You the User are responsible for your video footage and how you share them with others.

 

3.6 Where are my data hosted?

 

Your data are hosted with a third-party cloud service. Currently, we are working with Amazon Web Services (AWS). AWS has no access to your data.

3.7 How we Secure Information?

At Flybotix, we design our Platforms with your security and privacy in mind.

We realize how important and sensitive your personal data is, and we take a great number of measures to ensure that this information is securely processed, stored and preserved from data loss and unauthorized access. Our technical, administrative and organizational security measures are described in detail in our Security Policy.

 

3.8 Data Retention:

 

Account & Contact Data: we will only retain such data as long as necessary for the purpose for which it was collected, as laid out in this policy, including any legal retention period, or as long as necessary to carry out a legitimate and reasonable promotion of our products and to deliver the services on our Platforms.

Job Application Data: If we do not hire you, we may keep the information you provide for up to 3 years in order to contact you again for any new job proposition that may come up, unless you ask us not to do so. If we hire you, your personal information will be stored for the duration of your employment contract with us, and afterwards, during the applicable legal retention period that applies in the country where we employed you.

Audit Logs: are stored for 12 months, unless we need to keep it in relation with a legitimate concern related to the security or performance of our services, or as required by law.

Free Trial Session Recording: The recordings are automatically deleted after 2 months and may be deleted earlier once they have been processed, or considered irrelevant, or upon request.

 

3.9 Links to other sites

Our Platforms may contain links to other sites that are not operated by us. If the User clicks on a third-party link, he will be directed to that third party’s site. We strongly advise the User to review the Privacy Policy of every site the User visits. We have no access to the content, privacy policies or practices of any third-party sites or services. Therefore, we do not assume any responsibility in this regard.

 

4. Third Party Service Providers / Sub-processors.

We may employ third party companies and individuals to facilitate our Platforms (“Third Party Provider”), to provide the service on our behalf, to perform service-related services or to assist us in analysing and monitoring how our Platforms are used.

These third parties have access to the Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose. No third Parties are processing the Personal Data of you the User.

We collaborate with partners distributing our products and services (our Distributors), which may send us information about their customers such as name, company, industry, contact information, product or service purchased. We also send such information to Distributors for the purpose of them giving information on our products and services to you locally. If you would like to make any requests or queries regarding your personal data, please contact such Distributor(s) directly.

5. Applicable Law and Jurisdiction

This Policy and the rights and obligations of the parties hereunder shall be constructed, enforced and governed in accordance with substantive Swiss Law without regard to its conflicts of laws principles. In its scope of application, the GDPR and FADP must be respected. Any conflict arising out of or in connection with this Privacy Policy will be subject to an arbitrage, in the Swiss arbitrage centre:

Prior to that, the parties will endeavour to resolve the dispute through mediation.

We may update this Privacy Policy from time to time, to clarify it, to reflect any changes to our website, to our Services & Platforms, or to comply with legal obligations.
